Record EU-03 · Regulation (EU) 2024/1689
Lays down harmonised rules for placing on the market, putting into service and using AI systems in the EU, to protect health, safety and fundamental rights. It prohibits certain AI practices; sets requirements for high-risk AI systems, among them risk management, data governance, record-keeping, human oversight, accuracy and robustness; and imposes transparency duties for chatbots, deepfakes and machine-readable marking of AI-generated content. Providers of general-purpose AI models must document them; providers of models with systemic risk must also evaluate them, including adversarial testing, mitigate systemic risks and report serious incidents.
Adopted on 13 June 2024 and published in the Official Journal (OJ L, 2024/1689) on 12 July 2024; it entered into force on 1 August 2024, the twentieth day after publication. Article 113 as adopted set the application dates: 2 February 2025 for Chapters I and II (general provisions, including AI literacy, and the prohibited practices); 2 August 2025 for notified bodies, general-purpose AI models, governance and penalties, except the fines on providers of general-purpose AI models (Article 101); 2 August 2026 for the rest; and 2 August 2027 for Article 6(1) high-risk systems. Under Article 111, general-purpose AI models placed on the market before 2 August 2025 must comply by 2 August 2027, and AI systems in the large-scale IT systems of Annex X by 31 December 2030. Since 2 August 2026 the AI Office and national authorities enforce the Act; the AI Office holds the enforcement powers over general-purpose AI models. The AI Omnibus, Regulation (EU) 2026/1744 of 8 July 2026 (EU-18), published in the Official Journal on 24 July 2026 and in force since 27 July 2026, amended the Act: the high-risk rules now apply from 2 December 2027 for the Annex III use cases and from 2 August 2028 for AI systems in products covered by Annex I; a ninth prohibition, in Article 5(1)(ba) and (bb), of AI systems that generate non-consensual sexually explicit and intimate content or child sexual abuse material, applies from 2 December 2026; generative AI systems placed on the market before 2 August 2026 must meet the Article 50(2) marking duty by 2 December 2026; each Member State must have a national AI regulatory sandbox operational by 2 August 2027; Article 4 now requires providers and deployers to take measures to support AI literacy; the AI Office's oversight of AI systems built on general-purpose AI models is centralised; simplified requirements for SMEs are extended to small mid-cap companies; and access to regulatory sandboxes, including an EU-level sandbox, is widened. EUR-Lex holds a consolidated version of 27 July 2026.
