Status notes

Approved by the Government in council on 29 November 2024 and deposited by Elisabeth Margue, Minister Delegate to the Prime Minister for Media and Connectivity, on 23 December 2024; referred on 16 January 2025 to the Committee on Media and Communications, which appointed Félix Eischen rapporteur on 3 June 2025. Twelve opinions are on file, from the CSSF, ILNAS, FEDIL, the Chamber of Employees, ALIA, the Chambers of Commerce and Trades, the Competition Authority, the CNPD, the ILR, the Bar Council, the judicial control authority (23 January 2026) and the Council of State (10 July 2026, No 62.024). The Council of State raised formal objections, among them to the missing split of notifying tasks between ILNAS and the Government Commissioner (renamed Government Commissioner for Data Sovereignty by a law of 19 December 2025), to the CSSF's remit unless limited as Article 74(6) of the AI Act requires, to the regulatory and complaint-handling provisions of Article 9 and to inexact references in Article 14. As of the dossier's last update on 10 July 2026 the bill was in committee and had not been voted. The bill sets 2 August 2026 as the deadline for the CNPD's first regulatory sandbox, treats a real-world testing plan as approved when the market surveillance authority has not answered within 30 days, and follows the AI Act's fine ceilings (EUR 35 million or 7%, 15 million or 3%, 7.5 million or 1% of worldwide turnover).
