Summary

Draft Dutch act implementing the EU AI Act, put out for consultation on 20 April 2026. It would designate ten market surveillance authorities. Existing supervisors keep AI in their fields: RDI and ILT for critical infrastructure, AFM and DNB for financial institutions, product regulators (NVWA, NLA, ILT, RDI, IGJ) for regulated products, and the Procurator General at the Supreme Court and the chair of the Council of State's judicial division for courts. The Data Protection Authority (AP) covers most high-risk areas, the transparency duties and the prohibited practices. The RDI is the single point of contact, coordinating with the AP, and the authorities jointly run one AI regulatory sandbox.

Status notes

The internet consultation ran from 20 April to 1 June 2026. The State Secretary's letter to the House of the same day (Kamerstuk 22 112, nr. 4318) says that the cabinet accepted that the implementing act will probably enter into force later than the AI Act requires; that dates in the AI Act will probably shift as a result of the negotiations on the AI omnibus, whose changes are to be reflected in the bill where necessary and possible; and that after the consultation and the mandatory reviews an amended bill goes to the Council of Ministers and the Council of State before it can be submitted to the House. Under the proposal the Minister of Economic Affairs is the notifying authority for biometric systems, with RDI officials doing the work. The government published its list of fundamental-rights authorities in autumn 2024: the Netherlands Institute for Human Rights, the AP, the Procurator General at the Supreme Court, the chair of the Council of State's judicial division and the court boards of the Central Appeals Tribunal and the Trade and Industry Appeals Tribunal.

Refresh of 18 Oct 2026 under the rule that level A needs the instrument's own text or an official register. The record's official source, the internetconsultatie.nl page with the draft bill, still cannot be stored because the site's robots.txt disallows automated downloads, so the draft bill's own text has not been read. Re-read the Rijksoverheid news release of 20 April 2026 (stored 11 Oct 2026 as the record's secondary source), which confirms that the State Secretary put the proposal for the implementing act out for consultation that day, the consultation's end date of 1 June 2026, the ministry and the roles of the AP and RDI. Stored again in this run, with its PDF: the State Secretary's letter to the House of 20 April 2026, Kamerstuk 22 112, nr. 4318, on zoek.officielebekendmakingen.nl (recorded as an official Dutch government site on 18 Oct 2026, issue #127), which names the implementing act and the six-week consultation, sets out the steps after it (an amended bill to the Council of Ministers and the Council of State, then the House) and gives the ten authorities, the single point of contact, the sandbox, the notifying authority, the timetable and the fundamental-rights authorities. The news release and the letter are announcements of the draft bill rather than its text, so their quotes count as alt-official. No later stage of the bill is shown in the stored files.
