Summary
Amendment to the KommAustria Act (new § 17(8), § 18(3a) and § 20c) and the Telecommunications Act 2021 (new § 194a) that tasks the regulator RTR-GmbH with building and running a Service Centre for Artificial Intelligence. The centre runs an information portal on AI projects and advises the public, companies and public bodies on the regulatory framework for developing and using AI, technical documentation of AI systems, AI's effects on cyber security and AI already used in high-risk areas. The act also sets up an 11-member AI Advisory Board at RTR to advise the government on technical, ethical and societal aspects of AI.

Status notes
Introduced in the Nationalrat on 15 December 2023 as motion 3821/A by Eva-Maria Himmelbauer and Süleyman Zorba; the Constitutional Committee recommended it unchanged on 22 January 2024 (report 2419 d.B.), the Nationalrat adopted the act on 31 January 2024 and the Bundesrat decided on 15 February 2024 not to object. Promulgated as BGBl. I Nr. 6/2024; the new provisions apply retroactively from 1 January 2024. Supervision of the centre is split between the chair of KommAustria (for tasks linked to media regulation), the Federal Chancellor (its other media tasks) and the Finance Minister (its tasks under § 194a TKG 2021). The service centre receives EUR 700,000 a year from the federal budget. The Finance Ministry described it as a first step, to be developed into an AI authority (KI-Behörde). A parliamentary question of 2 April 2026 (5638/J) asked why Austria had still not designated the national authorities required by Article 70 of the AI Act although the deadline was 2 August 2025; the Minister for Housing, Arts, Culture, Media and Sport replied on 2 June 2026 that his ministry is not responsible for implementing the AI Act.

Recheck of 17 Oct 2026: re-read the Austrian Parliament page for 3821/A and the motion text (stored 11 Oct 2026) and the Finance Ministry press release of 22 January 2024 (stored again 17 Oct 2026; the page around the release changed, the release did not). Stored in this run from parlament.gv.at: the page of the Constitutional Committee's report 2419 d.B., the report itself and the text the Nationalrat adopted, which match the motion (recommended unchanged) and confirm the AI Advisory Board, the funding and entry into force on 1 January 2024; and parliamentary question 5638/J with the answer 5062/AB. The RIS copy of BGBl. I Nr. 6/2024 could not be stored (the archiver treats RIS's robots.txt answer, HTTP 503, as a refusal), so the promulgated text and its issue date are not confirmed by a stored file; BGBl. I Nr. 6/2024 is named on the parliament page. Version 1's promulgation date, the ORF report and the Commission's list of single points of contact rested on no stored file and were removed.
