Summary

Draft Commission guidance and a reporting template for the obligation of providers of high-risk AI systems, set out in Article 73 of the AI Act, to report serious incidents to national authorities. The obligation aims to detect risks early, ensure accountability, enable quick action and build public trust in AI. The draft guidance clarifies definitions, offers practical examples and explains how the rules relate to other legal obligations, and the approach seeks alignment with international initiatives such as the OECD AI Incidents Monitor and Common Reporting Framework. Both were published for stakeholder consultation.

Status notes

Published for consultation on 26 September 2025; the consultation, which sought feedback and examples on the interplay with other reporting regimes, closed on 7 November 2025. The consultation page gave August 2026 as the date from which the rules apply; following the political agreement on the AI Omnibus, the Commission states that the application of the high-risk rules was postponed to December 2027 for stand-alone AI systems and to August 2028 for AI embedded in products. Separately, on 4 November 2025 the Commission published a reporting template for serious incidents involving general-purpose AI models with systemic risk, which these providers must report to the AI Office under Article 55 of the AI Act; it supports Commitment 9 of the General-Purpose AI Code of Practice.

Re-read in the recheck of 17 Oct 2026: the Commission consultation page (official, stored 11 Oct 2026, last update 4 Nov 2025) confirms the draft status, publication on 26 Sept 2025, the closing date of 7 Nov 2025 and the content of the draft; the Commission library page of 4 Nov 2025 (stored 11 Oct 2026) confirms the GPAI serious-incident template. Stored in this run: the Commission's page on the targeted consultation on the high-risk classification guidelines (last update 16 June 2026), which concerns another instrument (EU-14) and is quoted here only for the postponed application of the high-risk rules. The draft guidance and the reporting template are offered only through ec.europa.eu/newsroom/dae/, which ec.europa.eu's robots.txt disallows, so they are not stored. No final version of the high-risk guidance was found on the Commission's pages or in a web search on 17 Oct 2026. Version 1's statements that Article 73(7) required the guidance by 2 Aug 2025 and that a Commission page lists a final high-risk template without a date are not shown in the stored files and were removed; version 1's statement that Article 73 follows the high-risk dates as revised by the Digital Omnibus is replaced in notes by the Commission's statement on the postponed high-risk rules.
