Italy's second legislative decree implementing the EU AI Act under Law 132/2025. AgID is the notifying authority; ACN is the market surveillance authority and single point of contact, with the Bank of Italy, CONSOB and IVASS for high-risk AI used in financial services and the data protection authority within Article 74(8) of the AI Act. ACN has inspection powers, including unannounced checks on real-world testing. Fines follow the AI Act ceilings and add up to EUR 1 million or 0.5% of turnover for breaches of Articles 27 and 86. AgID and ACN run a national AI sandbox. Employers must leave final employment decisions to a person, and workplace AI enters the occupational risk assessment.

Adopted under Article 24 of Law 132/2025 after a preliminary deliberation of the Council of Ministers on 10 June 2026, the opinions of AgID, ACN, the data protection authority, the Unified Conference and the parliamentary committees, and a final deliberation on 4 August 2026; issued on 7 October 2026, published in Gazzetta Ufficiale, Serie Generale n. 234, of 8 October 2026, and in force from 23 October 2026. It has 54 articles in five chapters. ACN registers the Annex III point 2 high-risk systems nationally; a coordinating committee at the Prime Minister's Office sets the sandbox's priorities, and sandboxes for dual-use and judicial AI are to follow by regulation. Follow-up acts are due within 90 days (teacher training, costs of market surveillance), six months (AI training in the professions and in continuing medical education) and twelve months (parameters adjusting professionals' fair compensation to the risk class of the AI they use). Article 52 makes data, algorithms and mathematical methods for training AI systems protectable as trade secrets under the industrial property code.
