Executive Order 14365; 90 FR 58499 (FR Doc. 2025-23092)

Summary

Sets a policy of a 'minimally burdensome' national AI framework and acts against state AI laws until one exists. The Attorney General must set up an AI Litigation Task Force to challenge conflicting state AI laws; Commerce must publish an evaluation identifying 'onerous' ones and bar states with them from BEAD non-deployment funds as far as federal law allows; agencies must assess whether to condition discretionary grants. The FCC is to consider a preemptive federal reporting and disclosure standard, and the FTC must say when state laws requiring changes to truthful AI outputs are preempted. A recommended preemption law must spare state child-safety, AI infrastructure and procurement laws.

Status notes

Signed 11 December 2025 and published in the Federal Register on 16 December 2025 (90 FR 58499). The order gave 30 days for the AI Litigation Task Force and 90 days (to about 11 March 2026) for the Commerce evaluation of state AI laws, the BEAD Policy Notice and the FTC policy statement; the FCC proceeding is due within 90 days of the Commerce evaluation. The Attorney General established the Task Force by memorandum of 9 January 2026, chaired by the Attorney General or a designee with the Associate Attorney General as vice chair. The order cites a new Colorado law banning 'algorithmic discrimination' (SB 24-205, US-CO-01); on 24 April 2026 the Department of Justice moved to intervene in xAI's suit against that law, alleging that it violates the Equal Protection Clause. The FTC's proposed policy statement on the suppression of accuracy in AI systems of 1 July 2026 (US-24) says the order directs the Commission to issue it. The White House's legislative recommendations of March 2026 (US-22) set out the preemption that section 8 asks for.

Recheck of 17 Oct 2026: federalregister.gov still returns a CAPTCHA page to the archiver (stored copies of 11 and 17 Oct 2026), so official_url is now the GPO Federal Register PDF on govinfo.gov, stored in this run (the same file as the eo-14365.pdf linked from the White House page). It confirms the title, EO 14365, the 11 Dec 2025 signature, 90 FR 58499-58501 (FR Doc. 2025-23092) of 16 Dec 2025 and the provisions; the White House text of the order, also stored in this run and now secondary_url, adds the President's name. The implementation notes rest on the Attorney General's memorandum of 9 Jan 2026, the DOJ press release of 24 Apr 2026 and the FTC's proposed policy statement of 1 Jul 2026, all stored in this run; the archiver flagged the DOJ release page for review because its title appears little in the text, but the stored text is the release itself. The earlier notes' statements on the Commerce list (not made public, per secondary sources), the 99-1 Senate vote on the moratorium, H.R. 5388 and the absence of a preemption statute rested on law-firm alerts and Axios and were removed (see open_questions). The summary now states the grant and FCC provisions as the order words them.
