Record US-NY-01 · Chapter 699 of the Laws of 2025 (S6953-B/A6453-B), as amended by Chapter 96 of the Laws of 2026 (S8828/A9449)
Requires frontier developers (of foundation models trained with over 10^26 operations) to publish a transparency report before deploying a new or substantially modified model, and large frontier developers (revenue above USD 500 million) to publish and follow a frontier AI framework for managing catastrophic risks, publish risk-assessment summaries and file disclosure statements. Critical safety incidents must be reported within 72 hours, or within 24 hours to an appropriate authority if death or serious injury is imminent. An office in the Department of Financial Services oversees compliance; the Attorney General can seek penalties of up to USD 1 million, or 3 million for later violations.
Both houses passed S6953-B (same as A6453-B) on 12 Jun 2025; it was delivered to the Governor on 9 Dec 2025 and signed on 19 Dec 2025 as Chapter 699 of 2025, with approval memo 76, the Governor announcing agreed chapter amendments. The chapter amendment S8828 (same as A9449) passed the Senate on 28 Jan 2026 and the Assembly on 11 Mar 2026 and was signed on 27 Mar 2026 as Chapter 96 of 2026. It repealed and replaced Article 44-B of the General Business Law as first enacted: a revenue test of over USD 500 million replaced the test of over USD 100 million in compute costs, the ban on deploying a frontier model that would create an unreasonable risk of critical harm was dropped, maximum penalties fell from USD 10 million and 30 million to 1 million and 3 million, and the effective date moved from the ninetieth day after enactment to 1 Jan 2027. Large frontier developers must also send the office summaries of catastrophic-risk assessments of internal use every three months and pay assessments to fund it. The office's annual reports begin on 1 Jan 2028. Accredited colleges and universities doing academic research and the Empire AI consortium are exempt, and there is no private right of action. The Governor described the law as building on California's recently adopted framework.
