Summary

Law on high-risk artificial intelligence systems, which make or are a substantial factor in making consequential decisions in education, employment, financial or lending services, essential government services, health care, housing, insurance or legal services. Developers and deployers must use reasonable care to protect consumers from known or reasonably foreseeable risks of algorithmic discrimination. Deployers must implement a risk management policy and program, complete impact assessments, notify consumers, and offer data correction and an appeal with human review if technically feasible. Consumers must be told when they interact with an AI system. The Attorney General enforces it.

Status notes

Approved and effective on 17 May 2024 (Session Laws 2024, chapter 198); the duties of developers and deployers were to apply on and after 1 Feb 2026, and the Attorney General may designate risk management frameworks and adopt rules. SB 25B-004 (2025 Extraordinary Session, chapter 3), approved on 28 Aug 2025 and effective on 25 Nov 2025, extended the effective date of the requirements to 30 Jun 2026. xAI sued to challenge the law in the US District Court for the District of Colorado on 9 Apr 2026, and on 24 Apr 2026 the US Department of Justice moved to intervene, alleging that it violates the Equal Protection Clause; Executive Order 14365 (US-20) also cites the law. Under a stipulated order of 27 Apr 2026, the Attorney General is not to enforce the law or investigate violations until 14 days after the court rules on a motion for a preliminary injunction that xAI is to file after final rule-making under the law or its replacement. SB 26-189 (US-CO-02), approved on 14 May 2026, repeals and reenacts part 17 as a law on automated decision-making technology in consequential decisions, taking effect on 1 Jan 2027.

Recheck of 18 Oct 2026: re-read the leg.colorado.gov pages for SB24-205 and SB25B-004 and the SB24-205 session law PDF (Session Laws 2024, chapter 198), stored on 11 Oct 2026, and stored in this run the leg.colorado.gov page for SB26-189, the Department of Justice press release of 24 Apr 2026 and a McDermott Will & Schulte client alert. The SB24-205 page shows 'APPROVED by Governor May 17, 2024' and 'EFFECTIVE May 17, 2024' and its bill history the Governor's signature on that day, and the session law ends 'Approved: May 17, 2024' after a safety clause; the signing date no longer rests on prior knowledge, and date_in_force is now the act's effective date (its duties were to apply from 1 Feb 2026, later 30 Jun 2026). The SB25B-004 page confirms the extension to 30 Jun 2026, approval on 28 Aug 2025 and effect on 25 Nov 2025. The SB26-189 page confirms the repeal and reenactment and the Governor's signature on 14 May 2026; its 1 Jan 2027 effective date is in SB 26-189's session law stored for US-CO-02. The suit's filing date and the DOJ intervention are in the DOJ release; the court and the stipulated order of 27 Apr 2026 rest only on the law-firm alert, which also calls the DOJ filing a 'companion complaint' where the DOJ release says it moved to intervene. Version 1's statement that the law never took effect is contradicted by the legislature's page and was removed. The Governor's name is not in the stored files. On 17 Oct 2026 robots.txt of leg.colorado.gov disallowed the session-law download paths, so the copies of 11 Oct 2026 were used.
