Summary

Treasury, the Department of War (through NSA) and DHS (through CISA) must develop a classified benchmarking process for AI models' advanced cyber capabilities, with the NSA Director setting the threshold for 'covered frontier models', and design a voluntary framework under which developers can give the government access to such models for up to 30 days before releasing them to other trusted partners. The order states that this authorises no mandatory licensing, preclearance or permitting of new AI models. It also directs CISA Binding Operational Directives, a Treasury-led voluntary AI cybersecurity clearinghouse, and DOJ prioritisation of prosecutions for AI-enabled hacking.

Status notes

Signed 2 Jun 2026 and published in the Federal Register on 5 Jun 2026 (Vol. 91, No. 108, pp. 34565-34567). Deadlines: Sec. 2(a) to (e) within 30 days (about 2 Jul 2026); Sec. 2(f), on expanding the United States Tech Force cybersecurity hiring and placement pathways, and the Sec. 3 benchmarking process and frontier-model framework within 60 days (about 1 Aug 2026). Under Sec. 3 the Secretary of Commerce is consulted through the Director of NIST; CAISI is not named. Under Sec. 2(c)(iii) CISA is to facilitate access to cybersecurity tools and services, including covered frontier models where appropriate, for agencies, state and local authorities and critical-infrastructure operators. The order revokes no earlier instrument. Participation in the pre-release access framework is voluntary for developers.

Recheck of 17 Oct 2026: re-read the whitehouse.gov text of the order stored on 17 Oct 2026 (it differs from the 11 Oct copy only in site navigation and related links) and the Federal Register print of the order linked from that page (whitehouse.gov PDF, 3 pages, 91 FR 34565-34567, FR Doc. 2026-11415, unchanged since 11 Oct). Together they confirm the title, EO 14409, signing on 2 Jun 2026, publication on 5 Jun 2026 and the content of Secs. 1 to 5. The stored federalregister.gov copy is a bot-check page and was not used. The stored sources do not show whether the 30- and 60-day deliverables, including the voluntary pre-release access framework, have been completed; that remark and the earlier description of the order as the first post-2025 federal instrument with frontier-model testing content (an evaluation not in the sources) were removed from notes. The summary now renders Sec. 3(c) as the order words it (no authority for mandatory licensing, preclearance or permitting) instead of 'rules out'.
