Summary

Binding rules for generative AI services offered to the public in China (24 articles). Providers must use lawfully sourced training data and improve its quality, prevent illegal or discriminatory content, label generated content, protect users (including against minors' over-reliance), and handle complaints. Services with public-opinion attributes or social-mobilisation capacity need a security assessment and algorithm filing. R&D that is not offered to the public is excluded.

Adopted at the Cyberspace Administration of China's 12th office meeting of 2023 on 23 May 2023 with the consent of the six co-issuing bodies, signed on 10 Jul 2023, published on the CAC website on 13 Jul 2023 and in force from 15 Aug 2023 (Art. 24). Generated images, videos and other content are labelled under the Deep Synthesis Provisions (Art. 12, CN-02), and services with public-opinion attributes or social-mobilisation capacity file their algorithms under the Algorithmic Recommendation Provisions (Art. 17, CN-01). The competent departments are to issue classified and graded supervision rules or guidelines for particular sectors (Art. 16), and services provided to China from abroad that break the rules can be dealt with by technical and other measures (Art. 20).
