Record TH-01
Draft general statute on artificial intelligence that ETDA and the Ministry of Digital Economy and Society put to public hearing in July 2026. It would cover AI affecting people in Thailand, even from abroad, and require foreign providers to appoint a local coordinator or representative. It prohibits AI using subliminal techniques or causing unfair broad-scale discrimination and provides for designating high-risk AI, whose deployers must manage risk, keep logs and report unforeseen risks; royal decrees may require notification, registration or licensing. Public agencies need ethical impact assessments, AI output must be machine-detectable and labelled, and liability is strict.

Tilleke & Gibbins give 2 July 2026 as the release date and about 30 days as the hearing period; comments went to the Ministry of Digital Economy and Society. The draft follows ETDA's public hearing of 11 to 24 June 2025 on the '(Draft) Principles of the Law on Artificial Intelligence', which proposed risk-based supervision of high-risk AI, legal promotion measures such as text and data mining and a regulatory sandbox, and a role for sector regulators. Regulation would be decentralised: sector regulators supervise AI in their fields and propose to a national AI planning committee which systems should count as high-risk, designated by royal decree in areas such as national security, health, environment, energy, telecommunications, transport and public utilities. Exempt would be AI used by individuals for personal or household purposes, research by higher education institutions with ethics committee approval, research and development before distribution, and systems prescribed by royal decree. Public agencies would record their AI uses in a central registry. The committee could designate 'contract-controlled AI businesses' serving government or critical infrastructure agencies and require data processing in Thailand for AI of national importance. The draft also provides for court-ordered suspension, recall or blocking through internet service providers, administrative fines of THB 1 to 5 million, a regulatory sandbox, and industry self-regulation that the committee may endorse. Core measures on launching AI products would apply on publication, and risk-control, supervision and serious-incident provisions 180 days later. After the hearing the draft goes to the Office of the Council of State, the Cabinet and the House of Representatives; the government aimed to start the legislative process by September 2026.
