Presidential decree implementing Korea's AI Basic Act, in force from 22 January 2026. It defines the defence, intelligence and police AI excluded from the Act (Art. 2), organises the National AI Strategy Committee and the AI Safety Institute, and fills in the Act's trust duties. AI business operators must give prior notice of high-impact or generative AI and may mark generative outputs in human-perceivable or machine-readable form (Art. 23). Enacted as Presidential Decree No. 36053 on 21 Jan 2026 and in force from 22 Jan 2026 (the digital medical device part of Annex 1 from 24 Jan 2026); its addenda repeal the Regulation on the Establishment and Operation of the National AI Strategy Committee and carry the committee over. Presidential Decree No. 36506 of 20 Jul 2026, in force 21 Jul 2026, added Art. 1-2, which lists the AI-vulnerable groups of Art. 3(5) of the Act (among them people with disabilities, people aged 65 or over, recipients of basic livelihood benefits, multicultural families and North Korean defectors), and requires impact assessments to reflect them (Art. 28). Presidential Decree No. 36580 of 18 Aug 2026, in force 20 Aug 2026, made a consequential change to Art. 2. Art. 25 sets the high-impact AI confirmation procedure, with a reply within 30 days. A domestic agent is required of operators with prior-year revenue of KRW 1 trillion or more, AI-service revenue of KRW 10 billion or more, or an average of 1 million or more daily domestic users (Art. 29).
