Record US-FL-06 · Laws of Florida ch. 2025-99 (CS/CS/HB 757, 2025)
Makes it a felony to possess lewd or lascivious images with intent to promote them or to knowingly solicit, possess or intentionally view them, including images modified by electronic or other means to show lewd exhibition in the presence of an identifiable minor, and to solicit child pornography. Under Florida's altered-sexual-depiction statute, willfully generating such a depiction of an identifiable person without consent, by computer-generated or other means, soliciting one, or possessing one to maliciously promote it becomes a third-degree felony. Victims may sue those who generate one or possess one to promote it for injunctive relief, USD 10,000 or actual damages, and attorney fees.
Borderline scope Existing scope_note kept: not AI-specific, included for the generation offence.
Passed the House 115-0 on 23 Apr 2025 and the Senate 37-0 on 24 Apr 2025, where it was substituted for CS/CS/CS/SB 1180; approved by the Governor on 27 May 2025 and effective 1 Oct 2025. 'Generate' means to create, alter, adapt or modify any image by electronic, mechanical or other computer-generated means to portray an identifiable person, or to offer or agree to do so. The generation and possession offences are ranked as Level 3 and the solicitation offence as Level 2 on the offense severity ranking chart. The law amends s. 836.13, F.S., the altered-sexual-depiction offence created in 2022 by CS/CS/SB 1798, and also sets criteria for when an image shows lewd exhibition of a minor's genitals for the purposes of the child pornography statute. Section 836.13 was also amended by ch. 2025-133 (Brooke's Law) and in 2026 by ch. 2026-14, ch. 2026-18 and ch. 2026-20; in the 2026 Florida Statutes the generation, solicitation and possession offences are subsections (2) to (4) and the civil action is subsection (7).
