Laws of Florida ch. 2025-133 (CS/CS/HB 1161, 2025); amends s. 836.13, F.S.

Summary

Known as Brooke's Law, it amends Florida's deepfake statute on altered sexual depictions. Covered platforms, meaning public websites and apps that mainly host user-generated content or regularly make nonconsensual altered sexual depictions available, had to set up by 31 Dec 2025 a process for an identifiable person or a representative to request removal of an altered sexual depiction published without consent. Within 48 hours of a valid request the platform must remove it and make reasonable efforts to remove known identical copies. Good-faith removals are shielded from liability, and failure to comply is an unfair or deceptive act under the Florida Deceptive and Unfair Trade Practices Act.

Status notes

Passed the House 116-0 on 16 Apr 2025 and the Senate 38-0 on 23 Apr 2025, where it was substituted for CS/SB 1400; approved by the Governor on 10 Jun 2025 and effective on becoming law, with the removal process due by 31 Dec 2025. A removal request must carry a signature, information to locate the depiction, a good-faith statement that it is not consensual and contact details, and platforms must give clear and conspicuous notice of the process. Providers of information or telecommunications services for content provided by others, e-mail, and services consisting mainly of preselected content are exempt. The removal duty adds to the civil remedies of s. 836.13, F.S., the altered-sexual-depiction offence that CS/CS/SB 1798 created in 2022. Section 836.13 was amended again in 2026 by ch. 2026-14, ch. 2026-18 and ch. 2026-20; in the 2026 Florida Statutes the notice-and-removal duties are subsection (8).

Recheck of 18 Oct 2026: re-read the Florida Senate bill page for HB 1161 (2025) and the two House staff analyses linked from it, stored on 14 Oct 2026 from flsenate.gov (the archiver found them unchanged on 17 Oct 2026), and the 2026 Florida Statutes page for s. 836.13, stored in this run. The bill page confirms the title, sponsors, history, floor votes (116-0 and 38-0), approval by the Governor on 10 Jun 2025, Chapter No. 2025-133, the effective date of 10 Jun 2025 and the citation of s. 836.13; the House final bill analysis of 18 Jun 2025 confirms the short title Brooke's Law, approval, chapter and effective date and describes the enacted provisions, on which the summary rests. The statute page shows the removal duties in force in subsection (8), in the terms the summary gives, and a history note citing ch. 2026-14, ch. 2026-18 and ch. 2026-20 after this law; it does not show which subsections those 2026 laws changed, so date_last_updated stays empty. The enrolled bill text was not stored.
