Summary

Would amend the Copyright Act to make it unlawful to share realistic digitally generated imitations of a person's personal characteristics, such as appearance and voice, or of performing artists' performances, without consent. An exception covers caricature, parody, satire and criticism of power and society, but not imitations that are misinformation able to seriously endanger others' rights or essential interests or to create a concrete danger to life or property. The bill also protects performances that are not artistic works, such as improvisations, and aims to secure the right to one's own body and voice and to get the tech giants to take manipulated content down quickly.

Language

Scope

Borderline scope A copyright-law bill rather than an AI-specific law; included because it is Denmark's operative instrument against sharing realistic digitally generated imitations of people (deepfakes).

Status notes

Implements the political agreement of 26 June 2025 between the then SVM government (Social Democrats, Venstre and Moderates) and six other parties to create protection against the sharing of digital imitations by amending the Copyright Act. A draft was notified under the EU TRIS procedure as 2025/0654/DK (received 31 October 2025, replacing the withdrawn notification 2025/642/DK; standstill to 3 February 2026, with comments from the Commission). The notified draft, titled in English 'Draft act amending the Copyright Act (Introduction of performance and presentation protection and protection against digitally generated imitations, etc.)', would add a Section 73a (personal characteristics) and a Section 65a (performances and artistic presentations) to the Copyright Act, protect both until 50 years after the year of death of the person imitated or the performer, let courts order infringing copies removed from the medium where they are made available, and enter into force on 1 July 2026; its exception did not yet mention danger to life or property. Culture Minister Zenia Stampe introduced the bill in the Folketing on 8 October 2026 as L 49, under a new title, and hopes it can enter into force at the turn of the year 2026/27. The bill also changes the rules of the Copyright Licence Tribunal (Ophavsretslicensnævnet) so that the same dispute cannot run before the tribunal and the courts in parallel.

Refresh of 18 Oct 2026. Stored and read: the Ministry of Culture press release of 8 Oct 2026 (kum.dk, Danish, the official_url), which says the minister introduces the bill that day and is not the bill text; the Folketing's open-data case record for the bill (oda.ft.dk, case 106034, stored in this run), which gives its official title and the number L 49 and shows no decision and no law number (oda.ft.dk is not yet listed as an official host, so these quotes count as secondary); and the EU IP Helpdesk news item of 1 Jun 2026 on the TRIS notification (stored as the secondary source). The English title renders the Danish title of the bill as introduced; the earlier English title was that of the 2025 notified draft, whose TRIS English text was stored on 14 Oct 2026 and backs the notes on that draft. The session 2026-27 in the identifier follows from the date of introduction. The bill text as introduced and the minister's written introduction on ft.dk could not be stored (HTTP 403, browser timeout), so the date of introduction rests on the press release, the summary rests on the press release, and the record is level B.
