Summary
Prime Minister's decision listing high-risk AI systems under the Law on Artificial Intelligence and Decree 142/2026/NĐ-CP. A system is high-risk if it may cause significant damage to life, health, lawful rights and interests, national interests, public interests or national security (Law Art. 9; Decree Art. 8(1)) and is not excluded by Decree Art. 8(2). Using AI systems does not change, transfer or exclude the powers and responsibilities of competent bodies, and human supervision, control and ability to intervene must be ensured. The annex lists systems in education, ethnic and religious affairs, health, banking, legal proceedings and transport, with conditions for each entry.

Status notes
Dated 30 June 2026, digitally signed for the Government portal on 2 July 2026 and in force from 15 August 2026 (Art. 3(1)); signed by Deputy Prime Minister Hồ Quốc Dũng. Transitional rules (Art. 4): providers and deployers of listed systems already operating before the effective date must meet their compliance obligations before 1 September 2027 (health, education and finance) or 1 March 2027 (other listed fields), and may keep operating meanwhile unless a competent state body finds a risk of serious damage and orders suspension or termination under Law Art. 35(2); systems put into operation within six months after the effective date must comply before 1 March 2027 (Art. 4(3)). The annex table marks each entry against point a or point b of Article 13(2) of the Law; the transport section has 31 numbered entries. Article 13(4) of the Law on Artificial Intelligence (VN-02) assigns the list to the Prime Minister.

Signed PDF of the decision (16 scanned pages) stored from the Government portal file server (datafiles.chinhphu.vn) and read by OCR (Tesseract, Vietnamese); Articles 1-4 read cleanly, the annex table less so (column layout breaks lines, some diacritics are lost). The PDF confirms number 33/2026/QĐ-TTg, the date 30 Jun 2026, the portal signature of 2 Jul 2026, Articles 1-4 (scope, criteria, effective date 15 Aug 2026, transition deadlines), the six field headings of the annex and the last transport entry numbered 31. The signer (Deputy Prime Minister Hồ Quốc Dũng, for the Prime Minister) is not legible in the OCR text; it comes from the stored VietnamPlus (Vietnam News Agency) report of 2 Jul 2026 and the stored LuatVietnam English text. The Decision's preamble cites the Law on Artificial Intelligence only generally; the Law's Article 13(4) giving the list to the Prime Minister is in VN-02's stored copy, not in this record's files. English version: the LuatVietnam page (commercial legal database) shows an English text of the Decision with Articles 1-4, the signature block and part of the annex; the rest of the annex needs a subscriber login. The page does not say who translated it; LuatVietnam says it distributes the Official Gazette's English translations, but nothing on the page marks this text as one, so it is recorded as a third-party translation. The summary was written from the Vietnamese text.
