Summary

Interim final export-control rule. It set a worldwide licence requirement for advanced AI chips (advanced computing integrated circuits), with licence exceptions for destinations that raise no national security concerns, default country allocations for most other destinations, and Data Center Validated End-User authorisations for entities that adopt security measures. It added a new control (ECCN 4E091) on the weights of closed-weight AI models trained with 10^26 or more operations, reviewed under a presumption of denial except for listed destinations; open-weight models are excluded.

Safety topics

Status notes

Published in the Federal Register on 15 Jan 2025 as an interim final rule with a request for comments, effective 13 Jan 2025. Exporters did not have to comply until 15 May 2025, and some requirements had a delayed compliance date of 15 Jan 2026. The new model-weight control is ECCN 4E091. On 13 May 2025 the Department of Commerce announced its rescission: BIS enforcement officials were instructed not to enforce it, and BIS said it would publish a regulation formalizing the rescission and issue a replacement rule. The same announcement issued guidance on the risks of using PRC advanced computing chips, including Huawei Ascend chips, and on protecting supply chains against diversion.

Recheck of 17 Oct 2026: federalregister.gov answers the archiver only with a bot-check page (stored 11 and 17 Oct 2026, including the browser copies). In this run the Federal Register printing of the rule (FR Doc. 2025-00636, 90 FR 4544) was stored from govinfo.gov (Government Publishing Office), and official_url now points at it. It confirms the title, BIS as issuer, publication on 15 Jan 2025, the 13 Jan 2025 effective date, the 15 May 2025 compliance date, RIN 0694-AJ90 and the controls in the summary. The BIS press release of 13 May 2025 (bis.gov, stored 17 Oct 2026) confirms the rescission announcement, the instruction not to enforce and the plan for a formal rescission regulation and a replacement rule. No stored source shows whether that formal rescission regulation has been published. The press release page was edited between 11 and 17 Oct 2026 ('SI' in place of 'AI' in places, one added bullet on Malaysia and Thailand); the passages quoted are the same in both copies.
