Status notes

Issued on 8 September 2025 and published in El Peruano on 9 September 2025. The decree enters into force 90 business days after publication, which falls in January 2026, except the First, Second, Fourth and Fifth Final Complementary Provisions of the Regulation, which applied from the day after publication. The transparency duties (Article 25) and the Title VI obligations are phased in: public sector within 1 year (executive, legislature, judiciary, autonomous constitutional bodies), 2 years (EsSalud, regional governments, public universities, public enterprises) and 3 years (local governments of types A to C; optional for types D to G); private sector within 1 year (health, education, justice, security, economy and finance), 2 years (transport, commerce, labour), 3 years (production, agriculture, energy, mining) and 4 years (all other uses); small enterprises 2 years and micro-enterprises 3 years. Public administration entities must also run security audits before and during operation, manage AI incidents and use NTP-ISO/IEC 42001:2025 when developing AI systems. AI used for national defence and security is outside the Regulation's scope provided it respects the principles of Article 7 (Article 4(b)); personal use is also excluded. Systems that are neither improper nor high-risk are of 'acceptable risk' (Article 22.2).

The instrument's own official text, or an official register, was stored and confirms the title, date and status. checked 2026-10-14 · official-url-fetched
Stored: the El Peruano HTML edition of Supreme Decree 115-2025-PCM with the full Regulation (Articles 1-36 and six final complementary provisions). It confirms the title, the number, issue on 8 September 2025, publication on 9 September 2025, the 90-business-day entry into force, the risk categories, the public-sector obligations and the phased implementation. Items c) and d) of Article 24.1 (high-risk uses) are missing from the stored copy itself, so the list of high-risk uses in the summary covers items a), b) and e) to j) only. The stored copy states the entry-into-force rule but not the resulting date; 90 business days after 9 September 2025 falls in January 2026 under any count of public holidays, so date_in_force is left empty. The Congress-hosted PDF (secondary_url) returned HTTP 404 and is not stored.
