Summary

Amends KRS 42.722 and 42.726 to define AI, generative AI and high-risk AI systems and consequential decisions, and makes the Commonwealth Office of Technology set standards for the responsible, ethical and transparent use of generative and high-risk AI by state bodies. Its AI Governance Committee develops standards adhering to ISO/IEC 42001, keeps a registry of such systems and runs an approval process. Agencies must disclose AI use to the public, explain AI decisions about citizens and offer appeals, and may use high-risk AI for consequential decisions only under a risk management policy. Candidates may also sue to require disclosures on synthetic media in electioneering communications.

Status notes

Its official title is 'AN ACT relating to protection of information and declaring an emergency.' Passed the Senate 30-3 (28 Feb 2025) and, with House Committee Substitute 1, the House 86-10 (13 Mar 2025); the Senate concurred 33-4, and the Governor signed the Act on 24 Mar 2025. An emergency clause made it effective on approval. The Commonwealth Office of Technology was to promulgate administrative regulations by 1 Dec 2025 and must report each year from 1 Dec 2025 to the Legislative Research Commission and the Interim Joint Committee on State Government on the AI registry, applications for AI use and third-party AI providers. In synthetic-media actions the sponsor of the communication is liable; the disseminating medium is not, unless it removes a disclosure or alters content into synthetic media.

Recheck of 18 Oct 2026: re-read the Kentucky General Assembly bill record for 25RS SB 4 and the Acts Chapter 66 PDF, both stored 12 Oct 2026 from apps.legislature.ky.gov (the archiver found them unchanged on 17 Oct 2026); the same Acts PDF is also stored as the record's secondary source, and Senate Floor Amendment 1, which would have removed the synthetic-media sections, is stored too. They confirm the title, the sponsors, the votes, the Governor's signature on 24 Mar 2025, the provisions and the emergency clause. The stored files give the sponsors' initials only and do not name the Governor, so the issuing body no longer gives full names. No current text of KRS 42.720 to 42.742 or KRS Chapter 117 was stored, so later amendments were not checked.
