Summary

Requires political advertisements, electioneering communications and other advertisements of a political nature that contain images, video, audio, graphics or other digital content made wholly or partly with generative AI, appearing to show a real person doing something that did not happen and created with intent to injure a candidate or deceive about a ballot issue, to carry the disclaimer 'Created in whole or in part with the use of generative artificial intelligence (AI).' It sets format rules per medium, makes failure by the payer, sponsor or approver a first-degree misdemeanour, adds civil penalties, and allows complaints to the Florida Elections Commission with expedited hearings.

Status notes

Passed the House 104-8 on 28 Feb 2024 and the Senate 32-0 on 1 Mar 2024, where it was substituted for the similar CS/CS/SB 850; approved by the Governor on 26 Apr 2024 and effective 1 Jul 2024. The AI disclaimer is in addition to the disclaimers the Florida Election Code already requires. 'Generative artificial intelligence' is defined as a machine-based system that can, for a given set of human-defined objectives, emulate the structure and characteristics of input data to generate derived synthetic content, including images, videos, audio, text and other digital content. In cases referred to the Division of Administrative Hearings, an administrative law judge must hold an expedited hearing. The law is codified as s. 106.145, F.S. (Use of artificial intelligence), which the 2026 Florida Statutes show unamended since ch. 2024-126.

Recheck of 18 Oct 2026: re-read the Florida Senate bill page for HB 919 (2024) and the two House staff analyses linked from it, stored on 14 Oct 2026 from flsenate.gov (the archiver found them unchanged on 17 Oct 2026), and the 2026 Florida Statutes page for s. 106.145, stored in this run. The bill page confirms the title, sponsors, history, floor votes (104-8 and 32-0), approval by the Governor on 26 Apr 2024, Chapter No. 2024-126, the 1 Jul 2024 effective date and the statute citation s. 106.145; the House staff final bill analysis of 30 Apr 2024 confirms approval, chapter and effective date and describes the enacted provisions. The statute page gives the codified text, on which the summary now rests, and the history note 's. 1, ch. 2024-126' only, so date_last_updated stays empty: no later amendment. The codified disclaimer ends with '(AI)', which the House analysis leaves out; the summary follows the statute. The enrolled bill text was not stored.
