Summary

New State Board of Education rule requiring the board of trustees of each Florida College System institution to adopt policies on the use and limits of use of AI, to ensure quality of education, efficient operations and a safe learning environment. The policies must cover compliance with privacy, copyright and other laws; notice to parents of enrolled minors who will directly use an AI instructional tool; academic integrity, barring AI use on graded work unless the instructor permits it; approved AI instructional and business tools; and an AI literacy framework. Tools designed to meet students' social needs or to simulate friendship or companionship are not AI instructional tools.

Scope

Borderline scope Borderline as a rule on AI use in one public sector: the State Board of Education requires the trustees of every Florida College System institution to adopt AI policies. Included because rules that a government body sets for a whole sector are in scope; the policies each college adopts for itself are not.

Status notes

A notice of rule development was published on 27 May 2026 and the proposed rule on 25 Aug 2026, with a hearing before the State Board of Education on 16 Sep 2026, at which the Board adopted the AI rules; no notice of change was published. The rule was filed with the Department of State on 30 Sep 2026 and takes effect on 20 Oct 2026. It incorporates by reference the U.S. Department of Labor's Training and Employment Notice 07-25, the AI literacy framework that institutions may consult. Each institution must reflect the policies in its manuals, handbooks and forms for students, employees, contractors and guests. The companion amendment to rule 6A-1.0957 sets AI safety requirements for school districts and charter schools.
