Status notes

Filed on 22 Dec 2025 and referred to Commerce and Tourism and to Appropriations. Commerce and Tourism reported it favourably (10-0) on 21 Jan 2026. Appropriations adopted a committee substitute (18-0) on 18 Feb 2026 that added, among other changes, a 45-day cure period, a news-media exception for AI-generated likenesses and the rules on AI instructional tools in schools. On 4 Mar 2026 the Senate adopted two floor amendments and passed the bill 35-2. It died in House messages on 13 Mar 2026 without becoming law; the similar House bill HB 1395 died in the Information Technology Budget & Policy Subcommittee the same day. The bill stated an effective date of 1 Jul 2026. As passed by the Senate, the Department of Legal Affairs would have enforced the chatbot, bot and data provisions as deceptive or unfair trade practices, with civil penalties of up to USD 50,000 per violation and a discretionary 45-day cure period; in answer to an alleged violation, a company could show controls aligned with the NIST AI Risk Management Framework and ISO 42001. A minor could have recovered up to USD 10,000 in damages from a chatbot platform. A bill with the same title and the same bill description, SB 2-D (US-FL-04), was filed by Sen. Brodeur in 2026 Special Session D on 24 Apr 2026, passed the Senate 37-1 on 28 Apr 2026 and died in the House Information Technology Budget & Policy Subcommittee on 29 Apr 2026.

Stored the Florida Senate bill page for SB 482 (2026), the Commerce and Tourism Committee's pre- and post-meeting analyses of the filed bill, the Appropriations Committee's analysis of the committee substitute (20 Feb 2026), the engrossed text S 482 e1 as passed by the Senate, and the Senate bill page for SB 2-D (session 2026D) with its Rules Committee analysis and Senate vote record (all flsenate.gov). The SB 482 page confirms the title CS/SB 482, the sponsor, the three versions, the 35-2 Senate vote of 4 Mar 2026, 'Died in Messages' in the House on 13 Mar 2026 and that no chapter law cites the bill; the summary and the enforcement details rest on the engrossed text. The SB 2-D page confirms its filing on 24 Apr 2026, the 37-1 Senate vote of 28 Apr 2026 and its death in a House subcommittee on 29 Apr 2026. Neither page nor the SB 2-D analysis says that SB 2-D refiled SB 482; the notes state only that both bear the same title and bill description. The Florida Phoenix report of 4 Mar 2026, the record's secondary source, returned HTTP 403 and could not be stored; the Governor's backing and the House Speaker's position, which no stored source shows, are no longer stated in the record.
