Summary

Interim report of the AI Strategic Council and its AI Institutional Study Group on Japan's AI regime, aiming to promote innovation while responding to risks. It relies mainly on existing laws plus guidelines and recommends a statutory basis for a stronger government command function and an AI strategy (basic plan); government guidelines in line with the Hiroshima AI Process for transparency and appropriateness across the AI lifecycle; promotion of safety evaluation and certification; government fact-finding on serious incidents with guidance and advice to businesses; and AI-specific procurement guidelines. Risks to life and safety and systemic risks stay with sector ministries for now.

Status notes

The AI Institutional Study Group was set up in July 2024 under the AI Strategic Council, which sits under the Integrated Innovation Strategy Promotion Council chaired by the Chief Cabinet Secretary with all ministers as members. It met seven times, heard 15 researchers, businesses and others, and held a public comment before the report. The report asks that the government's guidelines and fact-finding rest on law so that businesses, including foreign ones, can be asked to cooperate, and leaves national security risks such as CBRN development and cyberattacks to the ministries concerned. The Act on Promotion of Research and Development, and Utilization of Artificial Intelligence-related Technology (Act No. 53 of 2025) followed in 2025.
