Record US-WY-01 · HB0102 (2026); House Enrolled Act No. 32; 2026 Wyo. Sess. Laws ch. 91
Creates crimes involving AI: distributing, promoting or threatening to distribute nonconsensual synthetic sexual material of an identifiable person (W.S. 6-4-307), and knowingly developing or distributing an AI system specifically designed to create child pornography or synthetic sexual material (6-4-308) or to promote self-harm (6-4-701), each a felony with up to ten years' imprisonment. Using AI to generate child pornography is sexual exploitation of a child. Using AI to commit a crime is no defence (6-1-206), and developers are immune from damages for misuse by others unless the system was developed knowing or intending that its primary purpose would be illegal or illicit (1-1-143).
Passed the House 61-0 (21 Feb 2026) and, with Senate amendments, the Senate 31-0 (5 Mar 2026); the House concurred 58-1 on 6 Mar 2026. Signed by the Governor on 7 Mar 2026 and assigned Chapter 91, Session Laws of Wyoming 2026; effective 1 Jul 2026. The Act's title still refers to offences concerning the use of AI to censor political speech, but its enacted sections create no such offence. A second conviction for distributing synthetic sexual material carries up to twelve years. The development offences do not apply to systems that produce such content solely in response to user prompts without the developer's intent, to bona fide school, college, university, museum or public library activities, to law enforcement and judicial activities, or to interactive computer services for content provided by others; the self-harm offence also exempts licensed health care providers giving legitimate medical or therapeutic services.
