Summary

Bill that would have required developers of publicly available generative AI tools to offer a tool letting users apply provenance data to synthetic content made with the developer's tool, or to apply such data themselves where technically feasible, and to make a free provenance reader available. Provenance data, following widely adopted standards, would show whether visual content is synthetic and name the developer, without personally identifying information. Social media platforms would have had to retain available provenance data and make it accessible to users. Violations would have been unfair or deceptive practices, enforced only by the Attorney General after a 30-day cure period.

Status notes

Filed 4 Feb 2025. Reported favourably with committee substitutes by the Information Technology Budget & Policy Subcommittee (17-0, 19 Mar 2025), the Economic Infrastructure Subcommittee (16-0, 31 Mar 2025) and the Commerce Committee (25-0, 15 Apr 2025). The first substitute dropped provisions of the filed version on disclaimers on election materials, a pilot programme at the Division of Emergency Management and capture devices; the Commerce Committee replaced 'provider' with 'developer', removed audio from 'synthetic content' and excluded services that exclusively provide video game experiences. The bill would have created s. 501.9741, F.S., with an effective date of 1 Jul 2026. Placed on the House Second Reading Calendar, temporarily postponed on 23 Apr 2025, indefinitely postponed and withdrawn from consideration on 3 May 2025, and died on the Second Reading Calendar on 16 Jun 2025. The similar Senate bill SB 702 (Burgess) died in the Ethics and Elections Committee.

Recheck of 18 Oct 2026: re-read the Florida Senate bill page for HB 369 (2025) and the House Information Technology Budget & Policy Subcommittee (20 Mar 2025) and Economic Infrastructure Subcommittee (1 Apr 2025) analyses, stored from flsenate.gov on 14 Oct 2026 and found unchanged by the archiver on 17 Oct 2026, and stored again for this run, on 17 Oct 2026, the text of the third committee substitute (CS/CS/CS/HB 369, c3) and the House Commerce Committee analysis of 17 Apr 2025 (flsenate.gov; both byte-identical to the copies of 14 Oct 2026). The bill page confirms the title, sponsors, filing date, the four versions (c3 posted 16 Apr 2025), the committee actions and the 'Died on Second Reading Calendar' action of 16 Jun 2025; the c3 text, the last version of the bill, gives s. 501.9741, the July 1, 2026 effective date and the provisions on which the summary rests; the Commerce analysis gives the 25-0 vote of 15 Apr 2025 and the changes that committee adopted.
