Summary

Supreme Court of Florida opinion amending Chapter 4, the Rules of Professional Conduct, of the Rules Regulating The Florida Bar on the Bar's petition. It adds generative artificial intelligence to the comments on four rules: competence includes understanding the benefits and risks of technology, including generative AI; lawyers should be aware that generative AI may create risks to the duty of confidentiality; firms' internal policies should consider safeguards for their use of generative AI; and lawyers should consider safeguards when assistants or outside services use it. The amendments also allow testimonials by celebrity clients in lawyer advertising.

Scope

Borderline scope Court-adopted amendments to the conduct rules; AI content is a few comment sentences. Existing scope_note kept.

Status notes

The Florida Bar's Board of Governors approved the proposed amendments and published them for comment in The Florida Bar News; no comments were received. The Court adopted them except the proposal to delete 'zeal' and 'zealous' from the Preamble and the comment to rule 4-1.3, and the proposed amendments to rule 4-8.6 on suspended individuals and authorized business entities. The generative-AI language is in the Comments to rules 4-1.1, 4-1.6, 4-5.1 and 4-5.3, not in the text of the rules. The amendments took effect on 28 Oct 2024; a motion for rehearing would not alter that date.

CAUTION: no official source confirms the title, date and status; the record rests on secondary sources. Recheck of 18 Oct 2026: the Court's own PDF on supremecourt.flcourts.gov still could not be stored: on 14, 16 and 17 Oct 2026 the archiver was refused by the robots.txt of the Florida courts' download host. Re-read the copy of the opinion PDF hosted by ALM (assets.alm.com, publisher of Law.com), stored on 14 Oct 2026 and found unchanged on 17 Oct 2026 (Last-Modified 13 Apr 2026), which carries the Court's caption, case number, date, per curiam text, the vote and the appendix with the amended rules; title, date, status, the summary and the notes rest on this third-party copy. Whether the comments have been amended since October 2024 could not be checked against the current Rules Regulating The Florida Bar (floridabar.org refuses automated requests).
