Summary
Requires providers of generative AI systems with over 1,000,000 monthly users that are publicly accessible in California to offer a free AI detection tool, to give users the option of a visible (manifest) disclosure, and to embed a latent disclosure in AI-generated image, video and audio content that conveys the provider, the system and version, the time of creation and a unique identifier. Violations carry a civil penalty of $5,000 each. As amended by AB 853 (2025), large online platforms must let users inspect provenance data from 2027, and capture-device makers must offer and by default embed latent disclosures from 2028.

Status notes
Signed on 19 Sep 2024 as Chapter 291, Statutes of 2024, and originally to become operative on 1 Jan 2026. AB 853 (Wicks), Chapter 674, Statutes of 2025, signed on 13 Oct 2025, strengthened the Act; as amended, the covered-provider duties apply from 2 Aug 2026, the duties of large online platforms from 1 Jan 2027 and those of capture-device makers, for devices first produced for sale from that date, from 1 Jan 2028. In his AB 853 signing message the Governor asked the Legislature for follow-up legislation in 2026, before the law took effect, on technical feasibility and user privacy. AB 2713 (Wicks), 'California AI Transparency Act: system provenance data', approved on 30 Sep 2026 as Chapter 856, Statutes of 2026, amends Section 22757.3.1 of the Business and Professions Code, the duty of large online platforms to let users inspect system provenance data; as heard in committee in April 2026 it concerned users' download of content and its provenance data from those platforms.

Refresh of 18 Oct 2026 under the rule that level A needs the instrument's own text or an official register. Stored in this run: the Senate Weekly History No. 67 of 30 Nov 2024 (senate.ca.gov, compiled under the Secretary of the Senate), the legislature's record of SB 942, which gives its approval and chaptering on 19 Sep 2024 as Chapter 291, Statutes of 2024, and its subject title 'California AI Transparency Act'; the Assembly Weekly Histories No. 18 of 6 Feb 2026 and No. 37 of 5 Oct 2026 (clerk.assembly.ca.gov), which record AB 853 (approved and chaptered 13 Oct 2025, Chapter 674) and AB 2713 (approved and chaptered 30 Sep 2026, Chapter 856, amending Section 22757.3.1); and again the Senate Judiciary Committee's analysis of AB 853 (hearing of 15 Jul 2025), the Assembly Privacy and Consumer Protection Committee's analysis of AB 2713 (hearing of 16 Apr 2026) and the Governor's AB 853 signing message (a scan, read by OCR). Re-read: the Governor's releases of 29 Sep 2024 and 13 Oct 2025 (gov.ca.gov). Title, date and status now rest on the legislature's records; the covered-provider duties, the penalty, the operative dates and the summary rest on the two committee analyses, because the statute's text on leginfo.legislature.ca.gov refuses automated downloads (HTTP 403). No stored file says which act moved the operative date from 1 Jan 2026 to 2 Aug 2026, and the text of AB 2713 as enacted (it was amended in the Senate on 21 Aug 2026) is not stored, so the notes describe it only as heard in April 2026. The Senate Weekly History of 1 Oct 2026, stored in this run for US-CA-06, records a further amending act, SB 1000 (Becker), Chapter 861, Statutes of 2026; it is not a stored source of this record, so it is listed as an open question.
