Summary
Amends TSE Resolution 23,610/2019 on electoral propaganda. Propaganda using AI-generated synthetic content must say so explicitly, prominently and accessibly, naming the technology. Campaign chatbots and avatars are subject to the same duty and may not simulate dialogue with the candidate or another real person. Deepfakes of a living, deceased or fictitious person's image or voice used to harm or favour a candidacy are banned even with consent, on pain of loss of registration or mandate. Application providers are jointly and severally liable, civilly and administratively, if during the electoral period they do not immediately remove AI-manipulated content breaching the labelling rules.

Search shows that TSE Resolution 23.755 of 2 March 2026 amended Resolution 23.610/2019, apparently including the AI rules (new ban window of 72 hours before to 24 hours after voting, per press reports). Status notes
Adopted on 27 February 2024 (rapporteur Minister Cármen Lúcia) and published in DJE-TSE no. 29 of 4 March 2024, pp. 132-145; in force on publication (Art. 6). Besides the AI rules in new Articles 9-B, 9-C and 9-E, it adds definitions of artificial intelligence and synthetic content to Article 37 of Resolution 23,610/2019 and new duties for application providers (Art. 9-D), including measures against notoriously untrue or seriously decontextualised content and an election-year assessment of their services' impact on the integrity of the electoral process. The labelling duty does not cover image or sound quality adjustments, graphic identity elements and customary campaign photo montages (Art. 9-B § 2).
